Welcome to KEIVO. These Terms of Service (“Terms”) apply when you visit, browse, create an account with, or make a purchase through the KEIVO website (“Site”).
In these Terms, “KEIVO”, “we”, “us” and “our” means, trading as KEIVO. “You” and “your” means a visitor to, or customer of, KEIVO.
By using our Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Our Products and Services
KEIVO offers consumer products, technology accessories, home, workspace, automotive and lifestyle products through our online store.
We make reasonable efforts to ensure product descriptions, images, specifications, colours, pricing and availability are accurate. However, colours may appear differently depending on your screen, and packaging or minor product details may change from time to time.
Product information is provided for general guidance. Please read all product instructions, warnings and compatibility information before use.
2. Orders and Acceptance
When you place an order, you are making an offer to purchase the selected products.
An order confirmation email confirms that we have received your order. Your order is accepted when we dispatch the products or otherwise confirm acceptance in writing.
We may need to cancel or decline an order before dispatch if a product is unavailable, there is a pricing or product-description error, payment cannot be authorised, we reasonably suspect fraud, or the order cannot be fulfilled. If payment has already been taken, we will refund the affected amount.
You must provide accurate, complete and current information when placing an order. KEIVO is not responsible for delays or delivery issues caused by incorrect customer details.
3. Pricing and Payment
All prices are shown in Australian dollars (AUD).
Prices include GST where applicable, unless stated otherwise. Shipping costs and any other applicable charges will be shown at checkout before you complete payment.
We may change prices, promotions and product availability at any time. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing error.
Payment must be made using the payment methods available at checkout. Payments are processed securely by Shopify and our payment providers.
4. Shipping and Delivery
Most KEIVO products are stocked and dispatched locally from Australia.
Our current shipping options, costs, dispatch timeframes and delivery estimates are set out in our Shipping Policy, available on our Site.
Delivery timeframes are estimates only and may be affected by courier networks, weather, public holidays, regional delivery locations or other circumstances outside KEIVO’s reasonable control.
Ownership of products passes to you once payment has been received in full. Risk in the products passes to you when the products are delivered to the delivery address you provide, subject to your rights under Australian Consumer Law.
5. Products with Batteries or Rechargeable Components
Some KEIVO products contain lithium batteries or rechargeable components. These products must be used, charged, stored and disposed of in accordance with the product instructions and applicable safety requirements.
Do not use a damaged battery, cable, charger or device. Do not expose battery-powered products to excessive heat, fire, water or physical damage. Use compatible charging equipment only.
Certain battery-powered products may require special road-freight handling and may have different delivery timeframes or location restrictions. KEIVO may not offer international delivery for products containing lithium batteries.
Nothing in this section limits any rights you may have if a KEIVO product is faulty or does not comply with Australian Consumer Law.
6. Returns, Refunds and Warranties
Please see our Returns and Refunds Policy for information about change-of-mind returns, damaged deliveries and how to lodge a return request.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Any voluntary manufacturer warranty or KEIVO warranty offered for a product is in addition to, and does not replace, your rights under Australian Consumer Law.
7. Promotions and Discount Codes
Promotions, gift cards and discount codes are subject to any conditions shown with the offer.
Unless stated otherwise, discount codes cannot be combined with other offers, exchanged for cash, applied retrospectively, or used to purchase gift cards. We may change, suspend or end a promotion where reasonably necessary, including where there is an error or suspected misuse.
8. Accounts
If you create an account with KEIVO, you are responsible for keeping your login details confidential and for activity that occurs through your account.
Please contact us promptly if you believe your account has been accessed without permission. We may suspend or close an account where we reasonably believe it has been used unlawfully, fraudulently or in breach of these Terms.
9. Acceptable Use of Our Site
You must not misuse our Site. This includes attempting to:
- interfere with the security, operation or accessibility of the Site;
- introduce viruses, malicious code or harmful material;
- access information or accounts without permission;
- use automated systems to scrape, copy or overload the Site without our written consent;
- make false, fraudulent or unauthorised orders; or
- use KEIVO content, branding or intellectual property without permission.
10. Intellectual Property
Unless otherwise stated, all content on the Site—including KEIVO branding, logos, text, product photography, graphics, designs and layouts—is owned by or licensed to KEIVO.
You may use the Site for personal, non-commercial shopping purposes only. You must not reproduce, distribute, modify, publish or commercially use our content without our prior written consent.
11. Third-Party Services and Links
Our Site may include links to third-party websites, services or social-media platforms. These are provided for convenience only.
KEIVO is not responsible for third-party content, availability, privacy practices or transactions. Your use of third-party services is subject to their own terms and policies.
12. Privacy
Our collection, use and disclosure of personal information is explained in our Privacy Policy.
By using our Site, you acknowledge that we may handle your personal information in accordance with that policy.
13. Liability
To the maximum extent permitted by law, KEIVO is not liable for indirect, incidental, special or consequential loss arising from your use of the Site or products purchased from it.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, warranty or other right that cannot lawfully be excluded under Australian Consumer Law.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, products, Site or legal obligations.
The updated Terms will be published on this page with a revised “Last updated” date. The Terms applying to an order are those in effect when you place that order.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any dispute relating to these Terms or the Site will be subject to the courts of New South Wales and Australia.
